Trading & Risk Disclaimer
1. What TradesmQ Is
TradesmQ is a self-directed software and trade execution tool for the user's own alert sources. It provides infrastructure for users to connect content they already have access to — their own webhook or their own Discord account read locally on their own computer — parse it into structured order tickets, and, at the user's discretion, transmit user-authorized order instructions to their own brokerage accounts through TradesmQ Relay. TradesmQ supplies, hosts, curates, ranks, and sells no signals or analyst content.
2. What TradesmQ Is NOT
- NOT a broker-dealer. TradesmQ is not registered as a broker-dealer with the Securities and Exchange Commission (SEC) or any state securities regulator. We do not execute, clear, or settle securities transactions.
- NOT a Registered Investment Advisor (RIA). TradesmQ does not provide investment advice, financial planning, or personalized recommendations. We do not recommend securities, strategies, or portfolio allocations.
- NOT a Commodity Trading Advisor (CTA). TradesmQ does not provide advice on futures, options on futures, or commodity trading.
- NOT a signal provider or creator. TradesmQ does not create, generate, originate, host, distribute, or endorse any trading signals. All alert content comes from the user's own sources (the user's own webhook or Discord account) and user-configured parsing.
- NOT an analyst endorser. Analysts are not employees, agents, representatives, fiduciaries, or investment advisers of TradesmQ. TradesmQ does not endorse, verify, or guarantee the accuracy, reliability, or performance of any analyst or their signals.
- NOT a discretionary account manager. TradesmQ does not decide whether, when, or how much you should trade. Automation features mechanically apply settings that you configure.
- NOT a fiduciary. Use of TradesmQ does not create a fiduciary, advisory, brokerage, agency, or portfolio-management relationship.
3. Risk Disclosures
- Trading stocks, options, futures, and cryptocurrencies involves substantial risk of loss, including the potential loss of your entire investment.
- Past performance of any analyst, signal, strategy, or the platform itself is not indicative of future results.
- Markets are volatile and prices can move rapidly against your position.
- Options trading carries additional risks, including the potential for total loss of the premium paid.
- Cryptocurrency markets operate 24/7 and are highly volatile.
- Leverage amplifies both gains and losses.
4. User Responsibility
- You are solely responsible for all trading decisions made through TradesmQ.
- You must perform your own due diligence and research before executing any trade.
- You should consult a licensed financial advisor for personalized investment advice.
- You are responsible for understanding the risks associated with every trade you execute.
- You choose which analysts to follow, what settings to apply, and whether to submit or automate order instructions.
- You must monitor your brokerage account directly and be ready to manually manage positions through your broker.
- You should only trade with capital you can afford to lose.
5. Algorithmic and System Risks
- Automated features (Auto Manage, breakout engine, software OCO, extended-hours stop monitoring, and server-side monitoring) can lag, fail, or produce unintended orders.
- Chart patterns, technical indicators, and algorithmic triggers are not predictive of future price movements.
- AI-assisted parsing can misunderstand analyst messages, extract incorrect symbols or prices, miss context, or classify messages incorrectly.
- API rate limits, network latency, or brokerage system outages may delay or prevent order execution.
- Order fills, partial fills, slippage, rejected orders, cancelled orders, and execution timing are controlled by market conditions and your broker, not TradesmQ.
- TradesmQ is not liable for losses caused by platform downtime, API failures, delayed execution, or incorrect order placement.
- Software bugs, server crashes, or infrastructure failures may occur. We make no guarantee of uninterrupted service.
6. Brokerage and Third-Party Services
- Order instructions are transmitted to your brokerage by TradesmQ Relay (the local broker bridge) running on your own computer. Brokerage credentials are entered into Relay and stay on your machine — they never pass through TradesmQ servers.
- Your use of brokerage features is subject to your brokerage's own customer agreement, terms, and permissions (account approval, margin, options levels).
- TradesmQ is not responsible for the actions, errors, or omissions of your brokerage or any other third-party service.
- Order execution quality, fills, and timing are determined by market conditions and your brokerage, not TradesmQ.
7. No Guarantees
TradesmQ makes no guarantees regarding:
- The accuracy, timeliness, or profitability of any content reaching TradesmQ through your own sources
- The performance of any author, publisher, or community you choose to follow
- The availability or uptime of the platform
- The execution or fill of any order
- The accuracy of any price data displayed
8. Regulatory Notice
TradesmQ is not registered with or regulated by the SEC, FINRA, CFTC, NFA, or any state securities regulator. The platform is designed as self-directed execution software, not as an advisory, brokerage, portfolio-management, or discretionary trading service. This notice is not a legal opinion and does not guarantee that every feature, use case, user location, analyst activity, or future business model will be outside registration or licensing requirements. If our services or features change in ways that affect our regulatory posture, we will update this disclaimer accordingly and seek appropriate counsel.
9. Acknowledgment
By using TradesmQ, you acknowledge that you have read, understand, and agree to the risks and disclaimers described above. You acknowledge that trading is risky and that you may lose some or all of your invested capital. You agree that TradesmQ, its owners, officers, and affiliates are not responsible for any trading losses you may incur.
